AGREEMENT TO TERMS

Hello and welcome to Kurato! By accessing and using the https://www.kurato.co.uk website, as well as any other media form, mobile website or mobile application related to Kurato, you are entering into a legally binding agreement with Kurato Ltd ("Kurato", "we", "our", or "us"). This agreement consists of the following Terms and Conditions ("Terms"). Whether you are acting on behalf of an entity or yourself, you agree to be bound by these Terms in their entirety. If you disagree with any part of these Terms, please do not use our website. Thank you for understanding, and we hope you enjoy your experience with Kurato.

Kurato reserves the right to modify, amend or update these Terms at any time and without notice. Any changes to these Terms will be posted on our website, and your continued use of Kurato constitutes acceptance of those changes. It is your responsibility to review these Terms regularly. We will make you aware of updates to these policies by sending an Announcement to your Vendor Dashboard and you will receive an Announcement email to your accounts email address.

If you violate any of these Terms, your access to Kurato may be terminated or suspended, and we reserve the right to remove any content posted by you.

1. PRICE INTEGRITY

Sellers agree not to sell any product on kurato.co.uk for a lower price elsewhere online. However, this restriction shall not apply to sales made through the seller's physical store.

2. COMMISSION

Sellers are charged a commission of 17.5% of the item price (Before any Tax or Postage is added). This commission will be automatically deducted from the total upon sale completion.

3. SHIPPING

Sellers must offer tracked postage for all products. This is to ensure that the products reach the customers safely and securely.

  1. Shipping Responsibility: As a seller on Kurato, you are responsible for the delivery of the items you sell. This includes packaging the items securely and selecting a reliable shipping service to ensure safe and timely delivery to the customer.
  2. Delivery and Packaging Fees: As a seller, you have the freedom to set your own delivery and packaging fees based on your unique business requirements. These fees will be clearly communicated to the customers during the checkout process and in the Product Description. Please ensure that your delivery and packaging fees are reasonable and accurately reflect the costs involved.
  3. Made to Order Items: Sellers on Kurato have the option to offer made-to-order items. When selling a made-to-order item the seller must make it clear to the customer that the estimated delivery time provided is from the date of dispatch, not the date of purchase. The seller should provide the customer with an accurate estimate of the time to dispatch in the product description.
  4. Delivery Time Estimates and Delays: Sellers are expected to provide accurate delivery time estimates for their products. However, unforeseen circumstances may occasionally lead to delivery delays. In such cases, the seller should reach out to the customer.

4. TRACKING INFORMATION

Sellers should provide tracking information to the customer within 24 hours of posting. This is to ensure that customers can track their items and have a clear idea of when they will receive them.

5. PRODUCT DESCRIPTIONS AND ACCURACY OF PRODUCT LISTINGS

Sellers are responsible for the accuracy of the media and descriptions on their product listings. Product descriptions should include all relevant information about the product, including its condition, size, color, and any special features or limitations. Kurato reserves the right to remove any product listings that are inaccurate, misleading, or fail to comply with UK and Scottish law.

6. PRODUCT AVAILABILITY

Product availability should reflect actual availability and this should be updated should this change. This is to ensure that customers are not disappointed when a product is no longer available.

7. MADE TO ORDER ITEMS

Where a product is made to order, then the approximate time to make the item should be stated very clearly in the product description. This is to ensure that customers are aware of the estimated delivery times and can plan accordingly.

8. DISPUTES

Sellers must discuss any disputes involving missing packages/broken items/refund requests/partial refunds requests the customer has, in the first instance, with the customer. When a resolution cannot be found, then the seller or customer can ask Kurato to get involved and potentially decide the outcome of the dispute based on provided evidence.

9. PROHIBITED ITEMS

Sellers must not list any prohibited items on the platform. Prohibited items include illegal items, counterfeit items, weapons, hazardous materials, adult content, and anything that violates copyright, trademark, or intellectual property laws.

10. INTELLECTUAL PROPERTY

Sellers must ensure that they own the rights to any images, videos, or other media used in their product listings. Sellers must not use any copyrighted or trademarked material without permission. Kurato has the right to remove any listings that violate intellectual property laws.

11. COMMUNICATION

Sellers must communicate with their customers in a professional and courteous manner. Sellers must respond to customer inquiries and requests in a timely fashion. Sellers must not engage in any form of harassment or discrimination.

12. PAYMENT OF EARNINGS

Payments of earnings are made upon the status of the Order changing to "Order Complete", which happens when the order is tracked as being delivered. Sellers are responsible for ensuring that their payment information is up to date and accurate on Kurato and on their Stripe or PayPal account.

13. TAXES

Sellers are responsible for paying any applicable taxes on their earnings. It is the responsibility of the seller to register for VAT if required. Kurato is not responsible for collecting or remitting any taxes on behalf of the seller.

14. TERMINATION

Kurato reserves the right to terminate a seller's account at any time, with or without cause. Sellers may also terminate their account at any time. Upon termination, any outstanding fees or commissions owed to Kurato must be paid in full.

15. MODIFICATIONS

Kurato reserves the right to modify the seller agreement at any time, with or without notice. Sellers will be notified of any changes to the agreement via email or through the platform. It is the responsibility of the seller to review and accept any modified terms before continuing to use the platform.

16. GOVERNING LAW

This agreement is governed by the laws of Scotland and the parties agree to submit to the jurisdiction of the Scottish courts in the event of any dispute.
